Terms of Sale

1. DEFINITIONS

“Order” means the order placed by you for Products, including any agreed changes after submission.

“Product(s)” means Fliteboard electric hydrofoil boards, accessories, and related equipment offered for sale.

“Purchase Price” means the total amount payable for the Products, including applicable taxes and fees.

“We”, “us”, “our” means Whistler Watersports CORP.

“Purchase Agreement” means these Terms of Sale.

 

2. GENERAL

This Purchase Agreement, together with any documents incorporated by reference (including warranty terms), forms the entire agreement between you and us for the purchase of Products.

By placing an Order and paying the Purchase Price, you are deemed to have accepted this Purchase Agreement.

3. YOUR PURCHASE

You agree to purchase, and we agree to sell, the Products described in your Order subject to these Terms.

All Product specifications, configurations, and inclusions are as outlined in your Order confirmation.

 

4. YOUR ORDER

  • Products will be supplied according to your selected specifications

  • Availability is not guaranteed

If a Product becomes unavailable:

  • We may offer alternative Products

  • You may accept or decline those alternatives

If you accept:

  • You must pay any price difference

  • You will receive a refund if the alternative is lower priced

You may request changes to your Order before shipment, but:

  • Approval is at our sole discretion

  • Changes may delay delivery

5. PAYMENT & CANCELLATION

Payment

  • Full payment is required to confirm your Order

  • Prices include applicable taxes unless stated otherwise

Cancellation

  • Once an Order is placed and processed, it cannot be cancelled except:

    • Where required by law, or

    • At our sole discretion prior to shipment

6. DELIVERY, TITLE & RISK

  • Products will be delivered to the address in your Order or made available for pickup

Risk Transfer

  • Risk of loss or damage passes to you upon:

    • Delivery, or

    • Pickup

You are responsible for:

  • Any import duties, customs, or regulatory requirements (if applicable)

 

7. WARRANTY ( FLITEBOARD )

All Products are subject to the manufacturer’s warranty.

Key warranty terms:

  • Typically 2 years from delivery for recreational use

  • Covers defects in materials and workmanship

  • Remedies may include:

    • Repair

    • Replacement

    • Reimbursement of repair costs

(These remedies are as per Fliteboard’s warranty structure )

Important exclusions:

Warranty does not cover:

  • Normal wear and tear

  • Misuse or improper maintenance

  • Commercial or rental use (unless specified)

  • Damage from improper storage, transport, or environmental exposure

We do not provide separate warranties unless explicitly stated.

8. SAFETY & ASSUMPTION OF RISK

Use of Fliteboard Products involves inherent risks, including serious injury or death.

By purchasing, you acknowledge:

  • These risks

  • That safe operation is your responsibility

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • We are not liable for:

    • Indirect or consequential losses

    • Loss of use or enjoyment

    • Economic losses

Liability is limited to:

  • The Purchase Price of the Product

10. TAXES

You must pay all applicable taxes associated with the purchase.

 

11. PRIVACY

Your personal information will be handled in accordance with our Privacy Policy.

 

12. GOVERNING LAW

This agreement is governed by the laws of British Columbia, Canada.

 

13. SEVERABILITY

If any provision is found invalid or unenforceable:

  • The remaining provisions remain in effect
